Achieving a successful consenting outcome for a prominent public space through community engagement

THE PROJECT

Surf life saving at Onemana beach is a much needed service that both locals and holiday goers alike greatly appreciate and need. However, the club building that acts as a headquarters for the life guards is aging which inhibits their capacity, efficiency and overall services at the beach.

Some of the key issues the club faces are:

• There’s not enough space for surf life saving training and emergency equipment;

• There’s no specialised first aid room;

• The surge in junior membership has meant the club has outgrown the current facility; and

• There are limited views down the beach for guards on duty.

In response to these issues, the Onemana Surf Life Saving Club proposed to upgrade the building in order to substantially improve its functionality and to better meet the needs of club members and the public. Some of these proposed changes included an internal reconfiguration of the existing building, adding a second level to the building and including accessibility ramps from the surrounding beachfront reserve.

THE APPROACH

4Sight worked collaboratively with the Onemana Surf Life Saving Club and their architect to develop a design that minimised visual impact and created a great community resource. We also took on the role of working with other supporting specialists to ensure a consistent and coherent approach to the project.

In order for the building changes to be successful, it was crucial to obtain buy in from local residents. We took the lead in this, and we were able to secure overwhelming local support for the proposal and provide a forum for those with objections to work through their concerns. Also, given the presence of Māori archaeological remains at the site, it was critical that Mana Whenua were involved in the design from the beginning and given the opportunity to exercise kaitiakitanga.

THE OUTCOME

Our ‘up-front’ investment with iwi and the tight-knit community meant that we could lodge consents with written support and have the archaeological and resource consent permits granted on a non-notified basis.

Throughout the project we demonstrated our abilities to guide the Client through the RMA process, effectively engage with stakeholders, prepare quality consent applications and to pro-actively correspond with Council representatives, all of which culminated in a successful consenting outcome that was greatly appreciated by the Onemana Surf Life Saving Club.

Obtained resource consents for residential redevelopment in a complex coastal environment

THE PROJECT

The 4Sight team were approached to provide planning, landscape and engineering advice for the redevelopment of a family holiday property on Motuarohia Island. We provided a range of project services including:

  • Initial resource management scoping and feasibility advice;

  • Attended pre-application meeting;

  • Advised on consultation strategy with iwi, neighbours and Department of Conservation;

  • Collaborated with wider consultant team (architects, coastal engineers);

  • Prepared landscape and visual assessment;

  • Prepared engineering services assessment;

  • Prepared joint coastal permit and land use consent application;

  • Worked through iwi consultation and further information requests during processing; and

  • Secured set of workable, fair consent conditions for the client for both the coastal permit and resource consent application.

THE APPROACH

The property was subject to several complex issues – including being an Outstanding Natural Landscape in a coastal environment with a significant local iwi interest, next to a highly popular Department of Conservation Reserve.

Our approach was to do our homework at the front end of the project, making sure that we had all the right consultants on board preparing the inputs necessary to support a successful application. We also made sure we were talking to all the key stakeholders early in the process – securing early support from both councils and the Department of Conservation was crucial.

THE OUTCOME

4Sight is proud of the result obtained for the client – both the coastal permit and land use consent were granted on a non-notified basis close to anticipated timeframes, despite the high profile nature of Motuarohia Island and the potential for public interest. The final conditions were fair and reasonable and the 10 year consent timeframe achieved for the land use consent gave the applicant flexibility with the staging and financing of the project. We also achieved the maximum coastal permit timeframe of 35 years for the new boat ramp.

Wānanga/focus group facilitation with Ngāti Toa

The Project

4Sight facilitated four focus groups, prepared detailed agendas, facilitated the kaupapa and engagement between technical science and coastal advisors (from GWRC and DOC) and recorded the outcomes and actions from each focus group.

4Sight assisted Ngāti Toa Rangatira:

  • To define and identify what cultural indicators were in a Ngāti Toa context;

  • To develop a framework for the initial indicators to sit within;

  • To develop initial indictors to be tested in Te Awarua-o-Porirua; and

  • In a testing day in Te Awarua-o-Porirua, where Ngāti Toa tested and trialled the marine cultural health indicators.

4Sight assisted GWRC and DOC by:

  • Preparing detailed materials, resources, and activities for whānau before each wānanga;

  • Preparing detailed agendas for, and recording actions from each meeting;

  • Recording detailed notes from each wānanga to assist reporting and project management;

  • Project management support between each wānanga; and

  • Working collaboratively and preparing high quality resources drawing on our wider expertise and experience in coastal, ecological and environmental projects.

The Outcome

We partnered with Ngāti Toa, GWRC and DOC to successfully deliver an initial set of marine cultural health indicators which whānau tested and trialled in Te Awarua-o-Porirua. We facilitated the ground work to allow Ngāti Toa to continue developing and refining the initial indicators, with support from GWRC and DOC science and coastal advisors. 4Sight continues to grow our relationship with Ngāti Toa, GWRC and DOC.

The Approach

4Sight assisted Ngāti Toa Rangatira, Greater Wellington Regional Council (GWRC) and the Department of Conservation (DOC) in leading a series of wānanga (focus groups) with Ngāti Toa Rangatira to develop an initial suite of marine cultural health indicators for their rohe.

4Sight leveraged our existing relationship with Ngāti Toa Rangatira, GWRC and DOC as a trusted advisor to facilitate the exchange of mātauranga Māori (indigenous and local Māori knowledge) and scientific knowledge. We adopted a whānau centred approach and assisted them to develop an initial set of marine cultural health indicators and to test these in Te Awarua-o-Porirua (Porirua Harbour).

HELPING NEW ZEALAND BUSINESSES MEET THEIR CONSENTING NEEDS

The Project

To meet their growing business needs, 4Sight was engaged to provide planning advice and assist Thornton Auctions with obtaining resource consent and a liquor license for their new premises in a light industrial in Mount Wellington. 

The Outcome

4Sight were able to successfully secure a non-complying resource consent on a non-notified basis and obtain a liquor license for a new auction house for Thornton Auctions in a light industrial area in Mount Wellington.

The Approach

Due to the sales nature of auctions, auction houses are considered as retail activities which are generally discouraged in industrial zones as they are primarily for activities such as manufacturing and distribution. Despite this, 4Sight recognised the unique nature and needs of auction houses that sets them apart from your typical ‘retail activities' and which makes them well-suited to commercial and light industrial areas. 4Sight managed the consenting process, provided strong justification, and overcame obstacles to delivery of consent decisions for their client. 

After researching various consultants to suit our needs for building and liquor consents 4Sight were engaged due to their scope of work, professionalism and willingness to work with a frustrated and very keen client. 4Sight were able to translate into laymen’s terms and work through the minefield of council requirements providing an excellent result for us. UNDERSEA IRON SANDS DECISION MAKING

4Sight was engaged by the Environmental Protection Authority (EPA) to assist the decision-making committee (DMC) considering an application to mine iron sands within New Zealand’s exclusive economic zone (EEZ). 

THE PROJECT

Trans Tasman Resources applied under the EEZ Act to mine 50 million tonnes a year of seabed material within the EEZ off the South Taranaki coast, for a period of 35 years. The Act applies to activities more than 12 nautical miles (22 km) offshore, and consent was required for both the mining and its associated discharge of material back to the sea floor.

The decision making responsibility was delegated from the EPA to the DMC. Our role was to work with the DMC and prepare the decision report. The purpose of the decision report was to document the significant range of evidence presented at the hearing, and to present the findings of the DMC.

THE OUTCOME

The DMC’s decision was to grant the consent, subject to an extensive suite of conditions setting discharge and receiving environment standards, operational management, and other environmental controls. We fulfilled our role by completing the 350 + page decision report in the available timeframe, to a standard acceptable to the DMC and the EPA. The decision report covered a wide range of matters including, among other things, the science and effects of suspended sediment; the potential for noise effects on marine mammals; and the relationship of effects to customary (iwi) fisheries.

Having worked closely with the DMC and EPA’s legal counsel, our final version of the decision report required only very minor editing after its submission to the EPA.

THE APPROACH

Our role in this project required intensive involvement over a period of six months. At the outset we were required to be familiar with the application and its supporting documents (which totalled approx. 4,000 pages of material). We attended most of the 22 days of hearing and the DMC’s  deliberations which spanned 27 days.

The project required us to establish a strong and trusted relationship with all members of the DMC, as well as the EPA. As a neutral advisor, we had to distil evidence for the DMC in a way that avoided any judgements about its value to the final decision (which was the DMC’s role). At times this was a very reactive role in response to various substantive issues pursued by the DMC during their deliberations. In doing so, we researched background reports, collated and summarised evidence, and prepared working drafts of the decision report.

As part of our work for the client, we were required to:

  • Contribute to the DMC’s decision making process in a neutral but productive way;

  • Understand the legal framework established by the Exclusive Economic Zone Act;

  • Have an in-depth understanding of the issues and evidence;

  • Distil and clearly present evidential themes from within background reports, individual briefs of written evidence, and daily hearing transcripts;

  • Link facts and evidence to proposed and final consent conditions; and

  • Accurately represent the findings of the DMC.

DIXON STREET HIGHRISE

4Sight obtained resource consent for this 20 storey apartment building and associated laneway development in Wellington.

The Approach

4Sight’s planners have a strong track record in providing advice on land and building development projects. All development projects have elements of risk; and for many that includes whether resource consent can be granted. Our expertise is in helping to de-risk or at least thoroughly understand that aspect of the project. We do that through identifying consent issues and ways to resolve them, plus ensuring that the application process runs smoothly.


For this project, the effects of the building’s height meant that it faced challenges in terms of both effects and the district plan rules. We dealt with this by setting out to thoroughly understand the site, the neighbourhood, all relevant planning documents, and likely effects – and using that understanding to help craft our planning assessment. In particular, we were able to convince the council that the characteristics of the site, neighbourhood and building meant that the application should be non-notified.


Our job was greatly assisted by Archaus Architects’ design which was ultimately judged to meet the council’s requirement for ‘design excellence’. Design excellence comes into play if a central area building exceeds the permitted height threshold. The concepts of quality design and design excellence are woven into a detailed policy context which includes the need for assessment against the central area design guide.

 

The Project

The project partners developed a concept for a 20 storey building on a site in Wellington’s CBD. The building design exceeded the site’s height limit by 35%. Our input to the project included:

  • Advising on the likely consent hurdles and the potential for success;

  • Working with the developer, architect, traffic engineer and other experts to address consent issues;

  • Ensuring that technical outputs by the project team were suitable for use in the consent application’s assessment of effects;

  • Preparing the resource consent application, including making a successful case for notification not being necessary;

  • Liaising with the council’s planner to ensure a smooth process;

  • Managing responses to further information requests issued by the council;

  • Negotiating practicable consent conditions with the council prior to the issue of consent;

  • Obtaining an encroachment licence for those parts of the building that extend into the airspace above legal road.

 

The Outcome

Construction of the project began in mid-2017. We are keen to see the final outcome as it includes a new laneway – linking Dixon Street with Feltex Lane to the rear of the site. Ground floor commercial spaces will open onto the laneway, as will the building’s three entry lobbies to the apartments above. This promises to be a dynamic new space contributing to Wellington’s lively and liveable downtown environment.

FERRARI SHOWROOM

4Sight was engaged by Sime Darby Motors to provide planning due diligence and advice, and subsequently prepared a resource consent for a new Ferrari Car sales showroom in Newmarket, Auckland.

THE APPROACH

4Sight’s planning team were involved early in the process. The site’s location meant effects such as streetscape appearance and amenity, traffic and parking were key for consideration. Clear communication with the project architect and client ensured smooth processing through Auckland Council and obtaining resource consent.

THE PROJECT

Working with the client and Sydney based architects Figgis + Jefferson Tepa, 4Sight prepared resource consent documentation to convert an existing building and carry out alterations to accommodate a new Ferrari car sales showroom along Manukau Road. The site was located in a key and prominent location on the corner of Manukau Road and Great South Road.

THE OUTCOME

Building a professional and collaborative relationship with the project team and client to obtain resource consent in a timely manner.

LES MILLS

4Sight have assisted Les Mills with planning services and specialist technical input over the years to assist them in meeting their business vision.

The Approach

A proactive and solution focused approach was adopted in all projects, with most of the projects involving various planning issues (from archaeology and parking through to urban design and acoustics) and a wide range of technical input. The lead planners in each project coordinating all inputs, while managing timeframes and client expectations. The projects where discussed with consenting authorities early on in the process to ensure a comprehensive application package was made addressing all the relevant issues.

 

 

 

 

The Project

4Sight have assisted Les Mills in preparing and securing resource consents for fitness centre facilities in a number of locations across New Zealand, along with submissions on Proposed District Plans and potential new fitness centre sites. 4Sight has been involved in obtaining resource consent for the new fitness centre facilities in Newmarket (Auckland), and Hamilton. Most recently, 4Sight has been successful in securing resource consent for the redevelopment of the ‘flagship’ Victoria Street facility, which involves the construction of a new 5 storey building, upgrading of the existing buildings and services and associated regional consents.

4Sight’s work has included the initial scoping/feasibility of new and redeveloped sites, preparation of Assessments of Environmental Effects, and liaising with Council staff and the Les Mills project teams on further information requests and draft consent conditions.  We have also assisted Les Mills with submissions to the Auckland Proposed Unitary Plan and the presentation of associated evidence to the independent hearings panel.

THE OUTCOME

The preparation and delivery of multiple resource consents across the country within scope, budget and timeframes. 4Sight’s involvement in multiple applications has resulted in a comprehensive understanding of key issues associated with the fitness centre facilities/sites and a strong and ongoing relationship with Les Mills.

BRINGING IMAGINATION TO LIFE

4Sight helps create a one-of-a-kind venue

THE APPROACH

4Sight took a collaborative approach with the project team to achieve the design intention for the treehouse, handling specific issues raised during the consenting process. Some of these issues included traffic management, intensity and scale of use, noise and other potential effects on adjacent rural sites. 4Sight also addressed district and regional planning requirements, to ensure the project adhered to these and non-notified consent was achieved. 

THE PROJECT

As part of an innovative advertisement campaign, Yellow Pages constructed a unique temporary venue to be operated as a restaurant, halfway up a Redwood tree in rural Auckland. 

The restaurant formed the focal point for a nationwide advertising commercial, with the construction process and initial operation of the temporary venue being filmed and used in compiling the advertisement. Our services for Yellow Pages included:

  • Preparing and managing the resource consent process

  • Providing initial feedback on the site and design brief

THE OUTCOME

4Sight provided essential specialist and planning services to inform the design and facilitate the resource consent process. This enabled the achievement of a hugely successful advertising campaign, and a unique venue for private hire that has won numeous awards and featured in more than 2000 blogs and publications worldwide.

THE APPROACH

4Sight took a collaborative approach with the project team to achieve the design intention for a pump bike track.  

4Sight’s contaminated land specialists undertook a contaminated soil review to assess risks and requirements under the relevant standards including:

  • National Environmental Standard for the Protection of Human Health against Contamination

  • Auckland Council Regional Plan: Air, Land and Water

  • Proposed Auckland Unitary Plan

They were able to overcome potential contaminated soil hurdles during the consent process by demonstrating that permitted activity conditions could be met during physical works.

4Sight’s planning team also prepared and managed the resource consent process, providing initial feedback on the site and design brief, addressing district and regional planning requirements. 
4Sight then handled specific issues raised during the consenting process such as storm water management, intensity and scale of use, noise and other potential effects on residential sites. Non-notified consent was achieved. 

THE PROJECT

4Sight provided planning and contaminated land services to Auckland Council’s Parks department to enable delivery of a new bike park within the Birkenhead War Memorial Park. The track opened in May 2016.  

THE OUTCOME

4Sight provided essential specialist and planning services to inform the design and facilitate the resource consent process. This enabled the achievement of a fantastic community asset which promotes exercise, recreation and family fun.

HELPING KEEP A ROOF OVER THE HEADS OF THOSE WHO NEED IT MOST

4Sight helps Accessible Properties meet the needs of property owners and tenants in the social housing sector. 

THE APPROACH

Accessible Properties often require advice within a short timeframe. 4Sight is able to respond promptly under pressure and inside constrained timeframes on a constant basis. 

Accessible Properties appreciates the ability to be able pick up the phone and contact 4Sight to ask for help as and when it is needed.

The Project

Accessible Properties are New Zealand’s largest non-government social housing provider. As are experts in social  housing,  they manage properties to meet the needs of property owners and tenants in the social housing sector. 

4Sight has assisted me with a number of IHC housing projects throughout New Zealand. They have always provided us with a timely response when we have needed it, this has often meant providing planning input to projects where time constraints have meant that the advice and services are required at short notice. I really appreciate the speedy help and professional approach that we always get.

IHC New Zealand is an organisation providing support and care for people of all ages with intellectual disabilities and Accessible Properties manages 1100 IHC properties. 

The demand for IHC assets, particularly its housing units, is in a constant state of change, as the demand for housing fluctuates from time to time and from location to location. Accessible Properties is required by IHC to manage its assets to meet these changing needs. Our services for Accessible Properties have included: 

  • Providing ongoing advice on planning matters related to their properties in locations throughout the lower North Island.

  • Providing planning services for the acquisition of resource consents for housing units (relocated buildings, new-builds or building conversions) to facilitate the supply of housing in areas where the demand is the greatest at that time.

The Outcome

4Sight has enabled Accessible Properties to quickly get the information it needs to move projects ahead and provide a better service to owners and tenants.

This collaborative approach has also been beneficial to IHC, who can rely on Accessible Properties and 4Sight to manage their building assets. This, in turn, helps IHC achieve their role of providing advocacy support wherever there is a need, and to stand up for the rights of one or all people with intellectual disabilities in New Zealand.

KAITIAKITANGA - A PARTNERSHIP IN PLANNING

4Sight helps ensure nature can flourish in an important location

THE PROJECT

Te Auaunga Oakley Creek is a scenic watercourse that holds social, cultural and biological importance within Auckland as a home to a wide variety of flora and fauna, both native and exotic.  But help is needed to restore and enhance the riparian ecology as it is under threat from the spread of invasive weeds, which suppress and prevent the regeneration of native flora. Our work has included:

  • Helping renew an archaeological authority permit to continue ecological restoration.

  • Identifying the need for resource consent because of a plethora of rule infringements under the operative district plan, the Proposed Auckland Unitary Plan and National Environmental Standards.

  • Engaging with iwi, Friends of Oakley Creek and local council to devise a collaborative solution.

THE APPROACH

4Sight recommended a programme of consultation with iwi, which eventually developed into a partnership that allowed Mana Whenua to exercise kaitiakitanga over the awa.  

  • Working collaboratively with Ngāti Whātua o Ōrākei, Ngāi Tai Ki Tāmaki and Te Kawerau a Maki, 4Sight drafted a Cultural Monitoring Programme named Ngā Aratohu o Ngā Kaiaroturuki (Cultural Monitoring Guidelines) that facilitated the opportunity for those iwi groups to manage the environment and provide Mātauranga Māori (i.e. traditional knowledge, wisdom, understanding or skill).

  • Developed GIS maps for the project team locating known archaeological and contaminated sites,

  • Developed a soil handling plan to mitigate the risk of exposure to contamination during works,

  • Designed guidance sheets to help contractors and volunteers identify archaeological remains, as well as protocols to follow should further archaeological sites be encountered.

THE OUTCOME

The application for resource consent was accepted and processed without any formal request for further information (i.e. Section 92 requests), and was granted in June 2016.  The Archaeological Authority to Modify was finalised a week earlier at the end of May 2016. 


Weed control and planting works is back underway, and we look forward to seeing the continued enhancements at Te Auaunga Oakley Creek over the next ten years.

SAVING TIME AND MONEY BY HELPING TO SEGREGATE CLEAN AND CONTAMINATED SOIL

4Sight helps Transpower and its contractors with soil assessment and disposal options, saving them time and money. 

The project

4Sight have assisted Transpower on a number of different projects and on a range of sites. Our work has included:

  • Soil sampling and assessment;

  • Advising on soil segregation methods to determine which material can be disposed of as cleanfill versus managed fill;

  • Statistically analysing soil sample data to demonstrate to authorities that the majority of the soil is actually cleanfill, which saved the client more than $500,000;

  • Helping the client to avoid practices that could result in large areas of land being classified as potentially contaminated areas;

The approach

When 4Sight worked with the client on their Paraparaumu substation project, we provided a holistic contaminated land service centred around the goal of saving the client money by demonstrating that the majority of the site's soil could, in fact, be classified as cleanfill material.

The nature of the project meant that we had to adopt a reactive, collaborative approach. 4Sight were often asked to provide on-call soil assessment services in advance of substation upgrade or construction operations, and we worked closely with the contractors and disposal facilities to manage soil as cost-effectively as possible.

THE OUTCOME 

At the Paraparaumu substation, 4Sight helped the client save over $500,000 by helping to identify and segregate cleanfill from impacted soils, which meant that the majority of the material could be shipped offsite as cleanfill material. 

At other sites, we have helped Transpower avoid practices that could result in large areas of land being classified as potentially contaminated areas, thus costing them large amounts of money.

ACHIEVING A SUCCESSFUL OUTCOME THROUGH COLLABORATION AND TRUST

4Sight helped Auckland Council deliver an award-winning stream restoration and wetland project that helped to resolve flooding and improve the ecological and amenity features of an urban stream environment. 

The project

4Sight assisted with the environmental management and compliance apsects of the Martyn Wilson Reserve project. We also helped the client obtain consents and provided technical input to the project's contamination aspects where it was needed.

Key features of the project included:

  • Construction of a formed stormwater treatment pond;

  • Clearing of mangroves;

  • Extensive landscape native planting along the stream margins to reduce erosion and provide ecological habitat;

  • Constructed timber boardwalk and footbridge to improve community connectivity with the stream;

  • Control of the water flow from the pond via a weir which was constructed with special features to allow fish passage.

The approach

Our approach to the project was centred around high levels of trust and collaboration; we worked with several different consultancies and also went to great lengths to involve local residents and schools in the decision-making process.

This mutual respect and trust with the local residents, formed during high-level engagement at the project's consultation stage, was built upon by the construction team who established an outstanding level of rapport with the local residents.

Our role as the project's independent compliance advisor helped to achieve a greater level of buy-in from all parties. This meant that when design changes were required, a collaborative approach could be used and all parties were aware of the fast turnaround times required.

THE OUTCOME

The project was an outstanding success due to the high levels of trust, respect and collaboration between all parties involved. It was such a success, in fact, that it won numerous awards including the Excellence in Environmental Practice award at the New Zealand Engineering Excellence Awards 2013, the 2013 New Zealand Contractors' Federation Environmental Award for projects under $2 million, and the Ingenium Excellence Awards 2013 – Winner projects under $2 million.

Achieving a Successful Outcome Through Collaboration and Trust

Stream Restoration and Wetland Project. 4Sight helped Auckland Council deliver an award-winning stream restoration and wetland project.

HELPING AUCKLAND COUNCIL WITH THE SMOOTH ADOPTION OF NEW REGULATIONS

As a trusted advisor to Auckland Council, 4Sight helped to review the internal implementation and administration of their new Cultural Impact Assessment (CIA) provisions in the Proposed Auckland Unitary Plan (PAUP).

The project

4Sight worked with key council departments affected by the new CIA rules (as both a regulator and an applicant) to identify any issues and opportunities. We then came up with short, medium and long-term solutions to respond to the new requirements whilst maintaining their original intent.

We provided these solutions to the council and they were then discussed with Mana Whenua representatives at a hui to help identify the best way forward.

THE APPROACH

We worked with key council departments to gain a detailed understanding of the issues and the opportunities provided by the new rules. This helped us develop solutions for the council that reflected the individual needs and constraints of each department, whilst also helping the council maintain a coordinated and consistent relationship with Mana Whenua.

THE OUTCOME

Following our advice, Auckland Council has put measures in place to respond to the rules in a way that helps to avoid some of the potential issues that were raised when the PAUP was introduced. 

A key recommendation to establish an in-house public Mana Whenua consultation facilitation service was adopted. This provides an important service for “mum and dad” type applicants who may have no idea how to contact or consult with Mana Whenua.

WORKING TO OBTAIN RESOURCE CONSENTS IN THE FACE OF HEAVY TECHNICAL OPPOSITION

Ngati Tuwharetoa Geothermal Assets Limited (NTGA) engaged 4Sight in late 2011 to help acquire resource consents to take additional geothermal fluid from the Kawerau geothermal field, and then again for a second application to renew an existing consent to discharge residue geothermal fluid into the Tarawera River.

The project 

4Sight acted as the lead planning advisor for the take application, with key tasks being: 

  • Working in conjunction with the client and legal advisors to scope the case and evidence requirements;

  • Reviewing/integrating scientific and technical information and evidence (Council and Environment Court evidence);

  • Preparing draft conditions of consent;

  • Preparing and delivering planning evidence for the council hearing;

  • Reviewing council decisions and 3rd party appeals;

  • Preparing Environment Court evidence and negotiating conditions.

We are currently preparing to proceed to a public hearing for the discharge application. Our role has been more varied for this application. So far we have:

  • Reviewed scientific and technical information associated with the Tarawera River;

  • Identified critical gaps in the application and scoped project briefs to fill the gaps in short periods of time;

  • Prepared an application and assessment of environmental effects for the renewal in accordance with the RMA, which was accepted at first lodgement;

  • Liaised with barristers, Bay of Plenty Regional Council staff and other key stakeholders;

  • Carried out statutory planning assessments.

The approach

 The take application is still ongoing, and is primarily made up of scientific and technical issues. Ian Mayhew, a Principal Planning & Policy Consultant at 4Sight, has contributed significantly to a successful outcome by placing the environmental effects of the project into the context of the planning framework which ultimately decides the appropriateness of granting the consent.

Ian has also ensured that the application's renewal occurred smoothly and that critical dates were met, so that the client can continue to operate while the replacement consent is being assessed. The application's lodging date was fast approaching by the time 4Sight was commissioned, so we made sure the appropriate information requirements were identified at the outset, so that the application could still be prepared within relatively tight time constraints.

THE OUTCOME 

The resource consent for the take was approved by the Environment Court after a short hearing, where appeals were resolved and the consent's conditions were agreed upon. The resource consent for the discharge is currently being finalised. 

Throughout this project, we demonstrated our ability to work to extremely tight deadlines and also to obtain resource consents in the face of significant technical opposition. 

 

Ngati Tuwharetoa Geothermal Assets

Working to Obtain Resource Consents in the Face of Heavy Technical Opposition

Ngati Tuwharetoa Geothermal Assets Limited (NTGA) engaged 4Sight in late 2011 to help acquire resource consents to take additional geothermal fluid from the Kawerau geothermal field.

HELPING TRANSPOWER SAFELY REMOVE HAZARDOUS SUBSTANCES AND REUSE DECONSTRUCTION MATERIALS

As part of Transpower's Benmore and Haywards Pole 1 Deconstruction Project, 4Sight was engaged to assist where historic operations had resulted in mercury contamination within the building.  There was asbestos-containing material (ACM) present, and in some areas the ACM was also contaminated with mercury. 4Sight’s innovative protocol meant asbestos and mercury removal in a manner that provided for worker health and safety and environmental protection.  It also allowed crushed concrete from the deconstruction project to be used as backfill material, which avoided disposal costs and a reduced carbon footprint.

The project

 4Sight was engaged to help with the deconstruction of the Pole 1 buildings at the Benmore and Haywards substations, where historic operations had resulted in mercury contamination within the building.  There was asbestos-containing material (ACM) present, and in some areas the ACM was also contaminated with mercury.     

Transpower wanted to deconstruct the Pole 1 building and use the concrete from the process as fill material in the Pole 1 building's basement; however, this couldn't proceed until the asbestos and mercury were removed and the client obtained consent.

Drawing on our experience with national, regional, and district requirements, as well as international experience in ACM and mercury removal, we helped Transpower evaluate the human health and ecological risks and costs associated with various deconstruction, building reuse, and debris disposal scenarios for the project. We also helped the client reduce their potential liability by providing rigorous systems to document processes and maintain transparency in remediation activities.

The approach

In our work on the project, we:

  • Developed an innovative protocol for mercury and asbestos removal and removal evaluation;

  • Evaluated potential ecological and human health risks from reuse of cleaned concrete as on-site fill material;

  • Developed a resource consenting strategy, which was a joint effort by 4Sight's Land and Water Quality team and our Planning and Policy team;

  • Prepared consent applications;

  • Presented information to Canterbury Regional Council;

  • Provided recommendations for appropriate monitoring strategies to ensure environmental protection, including recommending guideline levels for surface water and sediment monitoring.

  • Monitored contractor works against the protocol; and

  • Evaluated air monitoring and other data

THE OUTCOME

4Sight’s innovative protocol meant the removal contractor did not require containment for asbestos removal.    By using our international contacts, we identified products that allow the safe removal of asbestos-containing tiles and adhesive without containment being required and with no airborne release of asbestos.  The protocol was approved by Environment Canterbury and WorkSafe NZ.  This innovation has resulted in a cost savings of over $100,000 at Benmore alone. 

Consent was granted with guideline values for environmental protection, and the monitoring programme as presented in the application was approved. Being able to reuse deconstruction materials on-site will save Transpower tens of thousands of dollars, with the alternative being off-site disposal.

TRANSPOWER POLE 1

As part of Transpower's Benmore and Haywards Pole 1 Deconstruction Project, 4Sight was engaged to assist where historic operations had resulted in mercury contamination within the building. 

BALANCING THE NEEDS OF THE CLIENT, COMMUNITY AND COUNCIL

2degrees officially launched its mobile service in 2009 but the team at 4Sight have been working with the company since 2005, successfully managing the programme delivery of the resource consent process for the company’s national network rollout.

THE PROJECT

Gaining resource consents for over 400 sites across New Zealand required 4Sight to work with 61 territorial local authorities and included:

  • Planning services for new site builds, site upgrades, site changes and moves;

  • Representation at pre-hearing meetings and public hearings

  • Local government liaison;

  • General policy and compliance advice;

  • Consultation support;

  • Training on the interpretation of the National Environmental Standard for Assessing and Managing Contaminants in Soil to Protect Human Health (NES);

  • Provision of general advice on the implementation of the NES at a specific site level;

  • Undertaking site-specific investigations to meet the requirements of the NES.


THE OUTCOME

Our longstanding and ongoing relationship with 2degrees demonstrates 4Sight’s ability to successfully deliver large, complex telecommunications projects on time, within scope and budget. It also shows our commitment to achieving high quality outcomes for all stakeholders.

THE APPROACH

Managing the coordination and delivery of the necessary consents, often in short timeframes, required a collaborative and flexible approach. Our planners worked within the 2degrees project teams which were divided into areas of the country, each with their own 2degrees Project Manager. The scale of the network build demanded a  range of scalable planning skills, which 4Sight was able to deliver in an integrated manner to satisfy the client’s daily, monthly and annual milestones.

On a programme of this nature and scale, hurdles will inevitably arise. The planning team's extensive knowledge and experience dealing with contentious sites made them excellent ‘problem solvers’, enabling the team to overcome obstacles and devise solutions that meet the needs of the client, community and council.

NAVIGATING THE CHALLENGES FACING A NEW MARINA

4Sight provided community and stakeholder engagement/consultation along with planning and specialist coastal ecological services to help develop a new marina in a challenging environment. 

The project

4Sight have been involved with the Sandspit marina project since its inception. So far we have:

  • Been involved in community and stakeholder consultation;

  • Prepared AEEs and lodgements for the project's various district and regional consents;

  • Carried out ecological assessments;

  • Reviewed submissions on the project and coordinated the applicant’s case at the joint council hearing;

  • Coordinated the lodging of an Environment Court appeal against a land use consent decision;

  • Managed a successful Environment Court-directed mediation;

  • Investigated a revised marina layout which would reduce construction costs;

  • Developed a programme for implementing all of the consent conditions and ensuring that engineers and contractors were aware of them;

  • Obtained council approval for the construction ecological and water quality monitoring programme and oversaw its implementation.

The approach

4Sight are the trusted planning and environmental consultancy for a number of clients across New Zealand on a wide range of coastal development projects including ports, ferry landings, marinas, wharves and reclamations. This experience has given us deep insight into the inner-workings of local government – in particular how to navigate their clients through complex RMA and related environmental matters.

We have a thorough understanding of the types of consents required for coastal projects and the different ways to ensure they're obtained quickly and cost-effectively. Our Principal Planner, Max Dunn, has successfully consented more than 8 marina developments himself, and has also acted as an independent hearing commissioner of the Onehunga Foreshore reclamation in Auckland. Our Principal Ecologist Mark Poynter has been involved in eight marina developments.

 

THE OUTCOME

4Sight has successfully guided the marina society through a difficult resource consent process and have successfully achieved their desired result. 

We advised the society on the costs for each phase of the project, and were able to work within agreed budgets for each of them. We also helped to identify design changes and consent conditions as part of our role in the project, which saved the society time and money.  

Moving forward, 4Sight is still playing an active role in consent condition implementation, which shows our ability to assists clients far beyond the resource consent acquisition phase – right through to project completion and operation.

Navigating the Challenges Facing a New Marina

4Sight provided community and stakeholder engagement/consultation along with planning and specialist coastal ecological services to help develop a new marina in a challenging environment.

BALANCING AESTHETIC, ECONOMIC AND ENVIRONMENTAL CONCERNS 

4Sight was engaged to provide ecological and planning services to help the client carry out a 16 lot residential subdivision in an ecologically sensitive area. 

The approach 

4Sight worked with the project's stakeholders to ensure development would lead to a positive environmental outcome. To achieve this aim, we collaborated with project engineers to incorporate environmental mitigation strategies into the design process. 

It was crucial to keep the site's anticipated effects and outcomes closely aligned with council expectations, so we made sure to keep an open line of communication with the council's project ecologist for the entirety of the project. 

We provided advice on stormwater outfall placement to help minimise any adverse effects on native vegetation within the Significant Ecological Area (SEA), and we remained in constant contact with the client to ensure the project's consenting requirements could be met without delaying the development timetable.  

The project

4Sight were involved in the project's early development stages right through to its completion. As part of our involvement, we:

  • assessed the site's ecological values, including the vegetation within and surrounding a SEA, encompassing stream and terrestrial habitats for birds, lizards, and bats;

  • prepared an Ecological Effect Assessment report;

  • prepared a Lizard Management Plan (LMP);

  • implemented the LMP, including lizard rescue prior to the works, housing and re-release following the works;

  • assisted the client with post consent monitoring;

  • prepared a covenant management plan.

 

The outcome

Thanks to our support, the client was able to successfully carry out a residential subdivision in close proximity to a Significant Ecological Area (SEA). Our input ensured that the subdivision's design provided long-term ecological benefits for the SEA whilst also making them an attractive feature of the subdivision.

Balancing Aesthetic, Economic and Environmental Concerns

4Sight was engaged to provide ecological and planning services to help the client carry out a 16 lot residential subdivision in an ecologically sensitive area. 

HELPING A FAMILY DEVELOP THIER MODERN DREAM HOME IN A TIGHTLY-CONTROLLED HERITAGE ZONE

4Sight was engaged by the Canal family to provide planning advice and obtain resource consent for the construction of a new dwelling within the Auckland residential 1 heritage zone. 

The project

The idea behind residential 1 heritage zone is to preserve the historic character of the early established neighbourhoods by discouraging development that doesn't fit well with the zone's character. Instead, it encourages renovations and new works to reflect the historic form and pattern of buildings and streetscape.

Upon seeing the client's architectural concept for their to-be new dwelling, it was immediately apparent to us that it would face heavy opposition from Auckland Council. The design consisted of several modular boxes constructed with concrete and steel, and the upper level being connected by a translucent atrium gateway. Rather than being a recessive nod to its heritage setting, the building would be an eye-catching architectural feature in its own right. 

THE OUTCOME

The application was processed with supporting reports from staff and was considered by an independent commissioner who was initially unwilling to make a decision because of the difficulty of making the building's appearance fit with the heritage neighbourhood. 

The commissioner then decided that the application would be best determined at a hearing so the proposal could be presented and discussed by all parties. 4Sight managed the client's hearing preparation, reviewed the supporting evidence and presented the planning evidence. As a result, resource consent was duly granted and the new home has been built.

The approach

The main issue of heritage assessment and interpretation was circumvented by arranging pre-lodgement meetings with several key council staff. Matters of concern were identified in the meeting, and we then helped the client reach a compromise by tweaking the concept to better reference some of the area's historic features without substantive changes to the building design needing to be made.

By doing so we were able to mitigate the main consenting risk and come up with a design that was both in line with the client's vision and supported by the council's heritage architect prior to lodgement. We then held onsite consultation meetings with council parks staff and helped the client obtain written approval for boundary infringements, trees and dependent works located within the adjacent reserve. At our advice, the client also obtained written approval of directly adjacent neighbours.

James was an essential member of the pre-build team. James understands heritage planning issues and ensured our architect was well prepared for the design review process. With his planning skill and good relationships with council staff, he was able to guide our modern architectural design though the risky resource consent process, and represented us professionally at the hearing. 4Sight was engaged by the Canal family to provide planning advice and obtain resource consent for the construction of a new dwelling within the Auckland residential 1 heritage zone. 

BALANCING CLIENT EXPECTATIONS, ENVIRONMENTAL CONCERNS AND REGULATORY REALITIES

4Sight helped Automotive Holdings Group assess the resource consenting constraints for the redevelopment of their industrial site in late 2010, and in 2011 helped them gain consent for their Ford & Mazda showroom redevelopment. 

The project

Automotive Holdings Group engaged 4Sight in 2010 to assess the resource consenting constraints for their industrial site's redevelopment. Our involvement in the project saw us assessing a potential contamination at the site and helping the client gain consent to redevelop the western section so that they could build a new Mazda showroom.

We were then subsequently engaged in 2011 to help the client gain consent for the redevelopment of their Ford showroom, situated in the eastern section of the site, and to carry out a contaminated site management plan and construction management plan.

 

THE OUTCOME

The site redevelopments required a number of parking spaces, and the parking shortfall was a significant hurdle in the resource consent process. To overcome this challenge, we had to obtain input from traffic experts and also carefully manage the client’s expectations. In the end an outcome was reached that alleviated the proposals' impact on parking in the area. 

Our ongoing relationship with the client, along with the successful outcomes we've achieved so far, demonstrate our ability to work with other consultants as “one whole team” and also to carefully balance client expectations, regulatory realities and environmental concerns. 

 

THE APPROACH

Both projects required input from a wide range of specialists. The scope of services to help the client gain consent included:

  • Carrying out initial site analysis and scope of required applications;

  • Organising and reviewing expert reports from architectural, acoustic, traffic, geotechnical and arboricultural professionals;

  • Providing site contamination advice, investigations and sampling;

  • Developing contaminated site management plans, construction management plans and health and safety plans;

  • Representing the client liaising with Auckland Council;

  • Preparing and lodging resource consents;

  • Managing the resource consenting process to ensure quick delivery of consent decisions.

We have recently completed a project with 4Sight for the redevelopment of a city fringe site. Balancing Client Expectations, Environmental Concerns and Regulatory Realities

4Sight helped Automotive Holdings Group assess the resource consenting constraints for the redevelopment of their industrial site

HELPING IWI FISHERIES ACHIEVE A MORE SUSTAINABLE FUTURE

To assist towards planning for, protecting and sustainably managing their freshwater environment and customary freshwater fisheries, 4Sight was engaged to help the eight mana whenua iwi of Te Tau Ihu gain a deeper understanding of their native freshwater environment.

The project

4Sight undertook a review of historical and current scientific and cultural research within the rohe, to understand the current state. A range of interview materials was then designed to capture and understand:

  • traditional fishing histories, tikanga and kawa specific to hapū or iwi;

  • mahinga kai sites, and taonga species – how they were and how they are now, individual perspectives on current issues and solutions, and

  • iwi aspirations for the future.

Face-to-face interviews were carried out with Kaumātua throughout the rohe. The interviews were professionally filmed by writer and film director Wiremu Grace to capture these personal memories as part of the historical record. 

The final output provided a visual representation of environmental and historical information using GIS mapping to support the report.

The approach

We recognised from the start that our client was seeking more than just another scientific report, but more a reflection of the state of the rohe from an iwi and hapu perspective, represented visually and backed by hard facts.    This required a diverse set of skills encompassing ecology, freshwater and customary fisheries management, policy, GIS and an understanding of Te Ao Māori.

  • We gave a voice to iwi and hapū aspirations through interviews. Establishing relationships through correct protocol, acknowledging mana, and taking the time to talk and listen meant that Kaumātua felt comfortable to express their views, and share their history.

  • We used our familiarity with ecological databases and information sources to find and incorporate a wide range of relevant information.

  • We used GIS mapping to present information visually in a way that was easy to understand, while retaining a greater level of detail that could be analysed at any given time;

  • We presented the results orally, and provided digital copies of the GIS maps and final report.

The outcome

Iwi now have a clearer understanding and documented record of the state of the native freshwater fishery, the various pressures it faces, the regulatory mechanism, along with a clear picture of the information gaps that need to be filled to enable long term sustainable management.  

Prioritised recommendations to address information gaps were developed in line with iwi driven solutions that will help achieve iwi aspirations for freshwater fishery management.

Te Tau Ihu

The Native Freshwater Fishery

4Sight was engaged to help the eight mana whenua iwi of Te Tau Ihu towards planning for, protecting and sustainably managing their freshwater environment and customary freshwater fisheries.

WORKING WITH LOCAL GOVERNMENT TO BALANCE SOCIAL, ENVIRONMENTAL AND ECONOMIC OUTCOMES

4Sight has been providing planning and environmental related services to local government clients since 2001, and in doing so has helped to deliver more than $400 million of new public stormwater infrastructure in the Auckland Region.

The project  

4Sight has been working on the Auckland City Stormwater Capital Works Programme since 2001. Over the years we have been engaged to:

  • Identify RMA-related problems that were hindering progress on new capital works projects;

  • Recommend and implement a number of strategies to solve RMA-related problems;

  • Prepare standardised resource consent templates;

  • Development and implementation of consultation and engagement plans;

  • Identify all required permits including those under the RMA (District, Regional and NES), Historic Places Act, Reserves Act etc.

  • Acquisition of resource consents, including blanket consents;

  • Act as a single point of contact for driving applications through council;

  • Represent the client with key authorities and stakeholders;

  • Develop and manage service level agreements for iwi consultation;

  • Advise on, and investigate, contaminated sites;

  • Carry out ecological assessments;

  • Deliver specialist reports (through sub-consultants) on archaeological, aboricultural and ecological matters;

  • Manage health safety and environmental construction risks and drive best practice through outsourced compliance management services.

The approach

We also recognise that the Council's priority is to ensure that Auckland's ratepayers receive good value for money whilst also balancing the desired environmental, social and economic outcomes. 4Sight help to achieve this by enforcing a working culture of getting things right first time and understanding Council’s business from high-level strategies to their translation through on-the-ground project delivery.

It not only demonstrates our ability to consistently meet consenting time frames, thus allowing construction to proceed as planned, but it also shows our ability to collaborate and work as a team with a large number of different consultancies and contractors.

4Sight's involvement throughout the entire project life cycle has enabled our planners to gain a better understanding of the constraints associated with implementing resource consents and construction works. And as a result, no projects to date have proceeded to a public hearing process or the Environment Court.

4Sight has been providing planning-related services to local government clients since 2001, and in doing so has helped to deliver more than $400 million of new public stormwater infrastructure.

PROVIDING EXPERT ADVICE ON TE TIRITI O WAITANGI AND MAORI ENVIRONMENTAL ISSUES 

As a trusted advisor to the New Zealand government, 4Sight has provided policy analysis and advice to Te Puni Kōkiri on a range of environmental issues across government since 2012. 

The project

4Sight has been providing Te Puni Kōkiri with technical analysis and policy advice on a range of environmental issues across government since 2012, thanks to our expertise in Te Tiriti o Waitangi and Māori environmental issues.

We have been actively involved in cross-agency work programmes all across government, with the aim of increasing Māori participation in RMA processes.

One of 4Sight's senior planners, Jerome Wyeth, also led the development of two guidance documents which provide guidance on developing iwi management plans and cultural impact assessments. 

The approach

As part of our work for the client, 4Sight has developed close working relationships with several relevant agencies. We have collaborated on key work programmes with these agencies, with an end-goal of achieving a mutually beneficial outcome for the client.

4Sight's main strength in working with the client is our ability draw on practical RMA planning experience and knowledge of Māori environmental issues, which we use to deliver policy advice that is relevant, evidence-based and understandable. 

The outcome

Through our work with the client, 4Sight has been able to ensure that resource management reforms incorporate proposals to improve the participation of Māori in resource management processes. If enacted, these proposals will clarify iwi/hapū's role in RMA planning.

Launched in 2001, the Quality Planning Website provides resource management practitioners with robust guidance on all aspects of the Resource Management Act (RMA). 4Sight has contributed to this vital tool, ensuring that it always reflects current best practice and the latest legislative developments.

The project  

The guidance notes on the Quality Planning website must be continually updated to reflect current best practice and legislative developments, and at times new guidance notes need to be produced. 4Sight's role in this included:

  • Reviewing and updating guidance notes to reflect emerging good practice and legislative changes;

  • Developing and reviewing new guidance notes;

  • Project managing the transition of Quality Planning from an MfE-led to a partnership-led model of delivery;

  • Managing the day-to-day aspects of the Quality Planning programme.

The approach  

The Quality Planning program is a partnership between key resource management organisations. 4Sight reinforces this partnership approach by working as a key part of the client's team, often in-house, and by working collaboratively with:

  • The Quality Planning Partners;

  • Organisations responsible for resource management policy and regulation, such as central and local government;

  • Industry groups;

  • Other Resource management specialists.

Our approach is also underpinned by continually remaining up-to-date with emerging changes to the RMA and associated legislation, and to the development of other new legislation relevant to resource management combined with our extensive practical experience in delivering projects.

IMPROVING THE ENVIRONMENTAL AND RECREATIONAL VALUE OF A SIGNIFICANT REGIONAL LANDMARK

Ever since 2001, 4Sight has played a crucial role in helping Auckland City to identify and address the causes of poor water quality in Orakei Basin.

The project

4Sight has been working to improve Orakei Basin's environmental and recreational value for almost 15 years. Some projects we've worked on to help achieve this goal include:

  • Dredging contaminated sediments from the basin;

  • Options studies to improve water quality and address historical sewer overflow contamination in the creek;

  • Developing a strategy for the long-term management of the basin;

  • Extensive iwi, stakeholder and community consultation;

  • Resource consent acquisition for continued impoundment;

  • Acting as a facilitator between stakeholder groups and council, whose relationship had become fragile on a number of basin-related projects;

  • Helping the council to resolve significant resource management problems carried over from another consultancy;

  • Facilitating the delivery of a $3 million coastal boardwalk and cycleway around the basin;

  • Delivering a project to restore the failing access road and carpark;

  • Leading the design, investigation and consenting of further sections of the coastal boardwalk network.

The approach

We provided a holistic service which encompassed all of the environmental, community and planning aspects associated with the basin. These services included:

  • Working to understand the city's responsibilities under the Local Government Act, Reserves Act, Historic Places Act and RMA;

  • Maintaining strong working relationships, based on trust and mutual respect, with key parties such as iwi residents and environmental protection groups;

  • Identifying project delivery risks, and developing strategies to manage and address those risks to reduce costs and time frames;

  • Representing the council to internal stakeholders, external stakeholders and other interested parties;

  • Working collaboratively with other consultants to deliver the best possible outcome for the client;

  • Engaging with the local community;

  • Working with the contractors to ensure high levels of environmental compliance were achieved.

The ongoing success of the project can be attributed to the development of a long-standing relationship between 4Sight and the client that extends beyond the individuals involved. 

The outcome

The Orakei Basin is a unique archaeological and geological feature of the Auckland Region and an important recreational asset. Our long-standing involvement has encompassed a wide range of projects addressing many different types of resource management issues. The decision to continue the impoundment was a significant achievement, as despite opposing view points, the publicly notified consents were granted without needing to proceed to a public hearing. 

 We have successfully represented the council at Environment Court Mediation, and have helped to heal fragmented community relationships. Our work over the years has shown great innovation and has also been extremely cost-effective. 

4Sight have worked on a lot of sensitive and high profile sites for Auckland City Parks. They have taken on consents, communications and project management with a sense of ownership and drive. Current work on Orakei Basin has tied together archaeological, arboricultural and coastal marine aspects of consenting into achievable physical works. Their ability to deal with disparate and motivated stakeholders and give clear guidance to contractors has been integral to project success.

BALANCING ENVIRONMENTAL, SOCIAL AND ECONOMIC PRIORITIES FOR AN ABANDONED CONTAINER SHIP 

4Sight advised the Crown in its response to the MV Rena resource consent application. The container ship MV Rena grounded, broke up, and sank on Astrolabe Reef in 2012. 

The project

When the MV Rena's owners applied for consent to abandon the wreck on the reef and to discharge contaminants from the sunken cargo on an ongoing basis, the Crown engaged 4Sight to review the application documents and advise them on statutory process and environmental issues. We then prepared an “all of government” submission, and worked with a group of technical experts and Crown Law to provide expert planning evidence for the hearing which took place in late 2015. As part of our hearing work we took part in the conferencing of expert planning witnesses both before and during the hearing. 

The outcome

Our role was to help the Crown achieve a balanced outcome of environmental, cultural, risk and economic factors related to management of the wreck. The decision of the commissioners was that the wreck was allowed to stay, subject to a suite of conditions.

The approach

4Sight's initial report to the Crown required a substantial amount of documentation to be reviewed in a very short period of time. As a result, the work was shared between two of our principal planners.

We worked closely with Conservation staff to prepare the government submissions. We also worked alongside a wide range of technical experts to prepare the hearing evidence and to represent the Crown’s position during witness conferencing.

As part of our work for the client, we were required to:

  • Critically review the applicant's statutory planning assessment;

  • Review the relationship between aspects of the Resource Management Act and the Maritime Transport Act;

  • Understand the Crown's approach to previous submission processes;

  • Have a realistic expectation of the physically achievable outcomes for the wreck;

  • Understand the risk and significance associated with the contaminants;

  • Understand the cultural environment of the Reef, as a significant taonga for local iwi;

  • Act as an expert planning witness in presenting evidence and in contributing to witness conferencing.

MV Rena Wreck - Resource Consent Application

The MV Rena ran aground just off the Bay of Plenty coast in October 2011. 4Sight has been aiding and advising the Crown in the hearings process for a resource consent application to abandon the container ship on the Astrolabe Reef. 

HELPING MOVE WELLINGTON'S MOST SIGNIFICANT TRANSPORT PROJECT FORWARD

Since late 2013, 4Sight has been helping local authorities (Kapiti Coast District Council, Porirua City Council, Upper Hutt City Council and Wellington City Counci) to respond to the processes that flow on from the approval for Transmission Gully, 27 kilometres of new 4-lane motorway due to open in 2020.

The project

4Sight's statutory planning skills are being put to use on documentation which, as a condition of the consent, the council is required to certify. Our work on the project so far has included responding to: 

  • Issues of general accordance;
  • The outline plan and management plans that address specific environmental issues;
  • Enabling work plans;
  • New resource consents for works not originally expected to be a part of the project;
  • Proposed changes to the project's design and consent conditions.

The project requires intensive collaboration between the affected local authorities, and 4Sight plays an active role in making sure that the collaboration is channelled in a way that is both productive and mutually beneficial for all parties involved. 

The approach

4Sight is a key member of the team of council planners. Our approach is to identify and define issues, and then to broker solutions agreed upon between the councils, NZTA and the road builder. To do so requires us to: 

  • Take actions, within defined time frames, set by the approval conditions;
  • Adopt a flexible and responsive approach to time frames, with a goal of moving the project forward;
  • Proactively contribute to solutions for the councils as well as NZTA and the road builder;
  • Match our resources to the ever-changing demands of the project;
  • Work with planners, engineers, project managers and other professionals acting on behalf of the councils, NZTA and the road builder;
  • Take into account a wide range of environmental, engineering, project management and process issues.

The outcome

Though most of it will go unseen by the public, 4Sight's work on this project will aid the construction of a major motorway that passes through environmentally and physically challenging terrain.

Our work will ensure that the project meets its environmental and social objectives, has minimal adverse effects on sensitive natural environments in the area and is built on time, thus allowing it to make transport faster and easier for drivers in the Wellington region.

COASTAL DEVELOPMENT PROJECTS BENEFIT FROM TAKING AN INTEGRATED APPROACH

4Sight is currently working alongside Worley Parson engineers to deliver a range of port projects, including redeveloped cargo yard and wharf facilities, and continued maintenance dredging and offshore disposal for Eastland Port Ltd.

The project

4Sight are currently investigating various options for improving breakwater protection and extended vessel berthing/loading facilities. This has included, among other things:

  • Preparing environmental impact assessments;
  • Engaging stakeholders;
  • Contaminated land management;
  •  Working alongside various specialist such as acoustic engineers and archaeologists.

Our role was recently extended, and 4Sight are now responsible for managing Eastland Port's resource consent compliance programme. We are also currently preparing a Port Environmental Management Plan which covers port and related inland cargo.

Eastland Port recently lodged coastal permit applications for continued maintenance dredging and offshore disposal. As a result, we were required to review the Port of Gisborne's historical dredging and water quality data. The aim of doing so was to assess the the port's significance as a settlement area for juvenile crayfish, which some stakeholders see as an important issue. 

The outcome

By joining forces with our engineering partner, Worley Parson, 4Sight have been able to give the client a service offering which encompasses planning, environmental and engineering services – all of which are in relation to the development and maintenance of the port.

 As a result successful stakeholder consultation, the consent for continued maintenance dredging has been lodged on a limited notified basis. The port has also established a company-wide compliance management system – with clearly allocated responsibilities – thanks to 4Sight's ongoing compliance support. 

The approach

4Sight has been Eastland Port's trusted planning and environmental consultancy for a number of years, and has worked on a number of coastal development projects that straddle the land-coastal marine area interface, particularly in terms of new or extended infrastructure.

The experience we've gained from working on projects involving ports, marinas, walkways and wharves has given us significant insight into the inner-workings of local government, and in particular how to navigate their clients through complex RMA and related environmental matters.

Thanks to our experience working on a wide range of coastal projects, 4Sight's staff members have a deep understanding of the type of consents required and how to obtain them in a short period of time. A significant advantage of working with 4Sight is our ability to combine this knowledge with our own technical expertise in marine ecology, water quality management and contaminated land remediation.
